These general terms and conditions of sale will form the basis of the Distance Selling Contract and will be subject to the provisions of OUG 34/2014, as well as any other relevant regulations in force on the date of conclusion and performance of the contract. To the extent that there are regulations governing the same factual situation, regulations that are contradictory, the regulation with a more favorable character towards the party at fault will apply.
- Invoicing, payment and delivery policy
2.1. Product price, invoicing
Prices are displayed on the site in lei, namely: LEI (RON) with VAT. We do not assume responsibility to deliver orders if the price displayed on the site is incorrect for various technical reasons or due to human error when entering the price on the site.
2.2. Payment for products
The ordered products remain the property of HB Wine until the full payment of the payment amounts.
Payment for ordered products can be made:
1.refund/cash on delivery (customers, individuals or legal entities)
2.by bank transfer to our account (customers, legal entities or individual customers)
3.online by bank card (credit/debit card, including Romanian cards)
Online payment processing
Regardless of the currency you have in your account, transactions are made in lei, at your bank's exchange rate.
To offer you the option of online payment, we use the NETOPIA PAYMENTS payment processing platform.
When you opt for online payment, you will be redirected to the NETOPIA PAYMENTS platform, where you will be asked for certain personal data depending on the payment method chosen - for example, card data (card number, cardholder's name & surname, expiration date and security code on the back of the card). This data is used strictly for processing the payment through the NETOPIA PAYMENTS platform and is not communicated to us.
In certain situations, we may transmit a series of information regarding the transaction directly to the NETOPIA PAYMENTS platform, namely: transaction value, telephone number and e-mail address (if these have been completed in the customer's account).
In order to ensure the tracking of transactions and the settlement of payments, NETOPIA PAYMENTS provides us with reports regarding the payments we collect. These reports may include personal data of the payers (last name, first name, e-mail, telephone number, billing address). NETOPIA PAYMENTS transmits this data to us as part of the payment processing services.
In the event of problems arising strictly related to the processing of your payment, you will be able to be contacted directly by NETOPIA PAYMENTS representatives to resolve them.
The NETOPIA PAYMENTS platform processes your personal data as an independent operator for the processing of online payments. 2.3. Product delivery
The delivery period is between 2 and 5 working days, with express confirmation by HBWINE.RO of the interval in which the delivery is made.
The delivery period is calculated from the moment of payment confirmation.
Delivery is made only on the territory of Romania.
If the delivery periods cannot be met, hbwine.ro will notify the Customer of the estimated delivery period.
If the Customer does not provide correct information regarding billing or delivery, hbwine.ro may refuse delivery, without this being considered a breach of the Contract, or may establish a new delivery period, after the deficiencies are met. hbwine.ro reserves the right to refuse a new delivery to the extent that the inaccurate or erroneous communication of the above-mentioned data was made intentionally and without justification.
hbwine.ro does not assume responsibility for delays caused by the courier company, the responsibility being entirely its own, the undersigned guaranteeing exclusively the fulfillment of obligations relating to itself and its own employees.
To the extent that the customer is not found by the courier company at the address specified in the order, or the address specified in the order is not complete or contains inaccuracies, of a nature that makes it impossible to deliver the order, as well as in the event that the delivery should be made in an improper location, of a nature that endangers the integrity of the courier, which makes delivery impossible, the customer is fully liable for the cost of the transport.
To the extent that the customer returns and re-requests the order, all costs related to the new transport are its burden.
To the extent that the customer, after placing the order, notifies hbwine.ro in any way of his intention to no longer take over the ordered product, or refuses to take over the product delivered by courier, the price not having been paid, the customer is fully liable for the entire cost of transport or any expenses incurred by hbwine.ro as a result of placing the order that was unjustifiably abandoned.
Product delivery can be made by our own couriers or by specialized courier companies
Transportation is free for orders greater than 300 lei. For orders less than 300 lei, a fee of 30 lei is charged for the equivalent of shipping.
All costs will appear on the invoice, separately from the cost of the purchased products.
The ordered products are delivered throughout the country, using the delivery method and term chosen by you when placing the order.
In special cases (the ordered products are not in our stock, transportation difficulties) we reserve the right to increase the delivery period accordingly.
HB Wine reserves the right not to accept orders and/or deliveries from certain customers and/or to certain addresses.
2.4. Order Cancellation
2.4.1. Order Cancellation Before Shipping
- Free Cancellation: You can cancel your order without additional costs if it has not yet been shipped. To cancel an order, please contact us as soon as possible at [contact email] or at the phone number [phone number].
- Cancellation Confirmation: After confirming the cancellation, you will receive a confirmation email, and the amount paid will be refunded to your account within 5-7 business days.
2.4.2. Order Cancellation After Shipment
- Product Return: If you wish to cancel an order after it has been shipped, you can refuse the package upon delivery or contact us to arrange for the product to be returned. Return costs will be borne by the customer.
- Refund: Refund will be made after the returned product reaches us and is checked. Please note that the product must be in its original condition, unused and in its original packaging to be eligible for a refund.
- Copyright
All materials integrated into this site (including product descriptions, their promotion method, etc.) are the intellectual property of HB WINE SRL. These materials may not be copied or reproduced, except for the period necessary to view them online. Breach of this obligation gives HB WINE SRL the right to claim both damages and to oblige the guilty party to immediately cease the prejudicial act, which disregards the intellectual property of the subscriber.
- Registration as a member / Use of the site by persons under 18
By registering as a member, you will be asked to choose a username (e-mail address) and a password. You are responsible for keeping your access password safe as a member of the hbwine.ro site, any activity carried out under your username being entirely your responsibility. You agree to notify us immediately of any loss of your password or sign of unauthorized activity under your username. You are fully aware that any information, data, text, photographs, graphics, etc. contained in this site are the responsibility of the person/entity from which it originates. Under these conditions, we cannot in any way, directly or indirectly, be held responsible for the content of the site, including, but not limited to, truncated, incomplete or incorrect information, or for any consequences of its use.
hbwine.ro is not intended for persons under 18 years of age. Although they cannot be prevented, they do not have the right to send or post information on hbwine.ro, of any nature. Any such operation will be performed through the legal representative of the minor.
- Warranties and return policy
The products sold through this site each have a shelf life and a guarantee offered by the manufacturer. The warranty cannot be invoked in the event of improper or incorrect storage or use of the product.
Depending on the nature of the products, any individual customer (consumer) has the right to notify hbwine.ro in writing that he wishes to terminate the sales contract - purchase of the ordered product/products, without this giving rise to penalties and without the need to invoke any reason, provided that the termination occurs within a maximum of 14 days from the delivery of the order.
The customer assumes the obligation to bear the costs of returning the products within the 14-day period mentioned above.
The return of the ordered and delivered product/products will be made exclusively to the address in Oradea, str. Fabricilor no. 2D, jud. Bihor, postal code 410125, by sending them, at the expense of the buyer, through a courier company.
The value of the products ordered, delivered by hbwine.ro and subsequently returned by the buyer, under the above-mentioned conditions, will be refunded exclusively by bank transfer, to the personal account of the buyer.
For returned products that have damaged or incomplete packaging, signs of wear, scratches, bumps, etc. hbwine.ro will have the right to choose whether or not to accept the return or whether to reduce the amount returned, proportionally to the deficiency found upon return, meaning that, by bank transfer, the buyer will be refunded exclusively this value. The withdrawal from the contract and the return of the product will be made in accordance with the instructions presented in Annex B of OUG 34/2014.
In the event of exercising the legal right to return the product, hbwine.ro will reimburse its value, by bank transfer under the above-mentioned conditions, within 14 days of receiving the products, unless it is found that the returned product has shortcomings, deficiencies, damage, etc., in which case the price will be reduced proportionally.
Repeated termination of the contract, repeated return of products, without a real or objective justification, may be considered an abuse.
In any situation of returning the products, they must be in the same condition, sealed, in the original packaging and box, with the labels intact and together with all the documents that accompanied it (invoice, tax receipt or other documents), these conditions being cumulative, the absence of one giving the right the supplier to refuse the return and refund of the price.
Those products for which the manufacturer imposes special storage conditions will NOT be accepted for return by hbwine.ro, in accordance with OUG 34/2014 Art. 16 Lit. d).
The provisions of this chapter are supplemented by the provisions of OUG 34/2014, in the case of purchasing products from this site using distance communication techniques.
- Limitation of the supplier's liability
hbwine.ro cannot be held liable for any loss of the User or the Customer in the event that this is caused by failure to comply with these terms and conditions or by failure to comply with the Contract and the other instructions mentioned on the site.
hbwine.ro is also not liable for damages created as a result of the site not functioning as well as for those resulting from the impossibility of accessing certain accessible links on the site.
hbwine.ro is not liable for damages of any kind that the User/Customer or any third party may suffer as a result of hbwine.ro fulfilling any of its obligations under the Contract and for damages resulting from the use of the respective products after delivery and, in particular, for loss of products.
hbwine.ro is not liable to any customer/user for any requests outside of these terms and conditions, and cannot be held liable for any possible damage, material or of any other nature, which would derive, directly or indirectly, from facts or other circumstances that have not been mentioned in this section of the Terms and Conditions.
hbwine.ro reserves the right to cancel the order and not to reserve the ordered products if the customer cannot be contacted by phone within 24 hours of placing the order.
- Applicable law / Disputes
The contract is subject to Romanian law. Any disputes arising between hbwine.ro and the Client will be resolved amicably, meaning that the dissatisfied party will send, in advance, a notification, through a means of communication suitable for proving receipt by the other party, if this is not possible, the disputes will be resolved by the competent Romanian courts at the supplier's headquarters.
- Final Provisions
If any of the above clauses is found null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses. With the purchase and launch of the order, the client accepts without objection the conditions and terms of use, their value being the same as a validly concluded contract.
